HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40324 of 2016 ORDER:

The present writ petition is filed by the petitioner under Article 226 of the Constitution of India, seeking to declare the action of the 2nd respondent in not investigating and filing the charge sheet in FIR No.5 of 2016 as arbitrary and illegal.

Heard and perused the material available on record. The main grievance of the petitioner is that on the complaint filed by him before the 2nd respondent against the unofficial respondent, Crime No.5 of 2016 was registered. But the 2nd respondent did not choose to conduct investigation into the above crime. Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the 2nd respondent is directed to conduct investigation in the above crime, complete the same and file a final report in either way, as expeditiously as possible.

With the above directions, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
