HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.23788 of 2019 ORDER:

This writ petition is filed seeking the following relief: ".....to issue a writ, order or direction more particularly one in the nature of mandamus declare the inaction of the respondents in considering the application dated 08.06.2018 for appointment of mutavalli of Dargah Hazrath Syed Shah Suleman Buqari (shah bade sahib) situated at Chinchalpet Village, Nawabpet Mandal, Ranga Reddy District, as arbitrary and illegal and consequently direct respondent No.2 to consider the application dated 08.06.2018 and to pass such any other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard Sri G.Madhusudhan Reddy, learned counsel appearing for the petitioner and Sri Mirza Safiulla Baig, learned Standing Counsel appearing for the 2nd respondent. It is the case of the petitioner that he is the maternal grand son of one Zainuddin, who worked as Mutavalli of Dargah Hazrth Syed Shah Suleman Buqari. Since he is the only legal heir, he is eligible to be appointed as Mutavalli. Hence, he submitted an application dated 8.6.2018 to the respondents. But, so far, no orders have been passed thereon. Learned counsel appearing for the petitioner contended that appropriate orders be passed in the writ petition directing

the respondents to consider the representation dated 8.6.2018 submitted by the petitioner.

Learned Standing Counsel appearing for the respondents contended that since the representation is pending with the 2nd respondent, the 2nd respondent would consider the same and pass appropriate orders. Having considered the rival submissions made by the learned counsel on either side, this Court is of the view that this writ petition can be disposed of directing the 2nd respondent to consider the representation dated 8.6.2018 submitted by the petitioner and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending, shall stand closed.
