O R D E R

(Per Hon'ble Sri Justice Sanjay Kumar) The grievance of the petitioner in this case was with the order dated 28.05.2018 passed by the Tax Recovery Officer-3, Hyderabad, refusing to release the attachments made by him in Form No.ITCP-16 dated 25.01.2018, in connection with the demands pertaining to the assessment year 2012-13. Sri A.V.A.Siva Kartikeya, learned counsel for the petitioner, would state that the Assessment Order relatable to the assessment year 2012-13 was set aside by the Income Tax Appellate Tribunal Hyderabad Bench-B, in ITA No.1855/HYD/2017 and the matter was remitted to the file of the Assessing Officer to redo the assessment, but despite the same the Tax Recovery Officer-3, Hyderabad, refused to lift the attachment which was a consequence of the said Assessment Order.

We are now informed by Sri Vinod Kumar Tadakamalla, learned senior standing counsel for the Revenue, that the Tax Recovery Officer-3, Hyderabad, issued letter dated 10.07.2018 withdrawing the attachment effected by him under Form No.ITCP-16 dated 25.01.2018. A copy of the said letter addressed to the Sub-Registrar, Miryalguda, Nalgonda District, is placed on record. In the light of this development, the grievance of the petitioner stands settled. The writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs. _______________ SANJAY KUMAR, J __________________ T.
