HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.1424 of 2018 ORDER:
This Court passed interim order dated 19.12.2017 in WP.MP.No.53363 of 2017 in WP.No.43038 of 2017 which reads as follows;
"The grievance of the petitioners is that the unofficial respondent No.5 made constructions in the subject land obstructing the path way of the petitioners. The learned Standing Counsel for respondents 3 and 4 submits that petitioners made representation dated 23.02.2017 to the 4th respondent-Panchayat Secretary in this regard and that he would take appropriate action.
The 4th respondent shall cause verification whether any road exists in the subject land take appropriate action on the representation of the petitioners dated 23.02.2017, in accordance with law."
Counter is filed stating that the case of the petitioner was considered and order is passed on 30.01.2018 rejecting the application of the petitioner stating that there is no public road.
No reply affidavit is filed disputing the same. When the matter was listed on 04.01.2019 and 07.02.2019, there was no appearance on behalf of petitioners. In view of the aforesaid facts and circumstances, I do not see any violation of the orders passed by this Court.
Accordingly, the Contempt Case is dismissed granting liberty to the petitioners to challenge the rejection order dated 30.01.2018, in accordance with law. No order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 15.02.2019 tk
