THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CMA.No.64 of 2004 JUDGMENT: (Per Hon'ble Sri Justice R. Subhash Reddy) This appeal, under Section 28 of the Hindu Marriage Act, 1955, is filed by the wife aggrieved by the order dated 06.03.2002 in O.P.No.73 of 1998 passed by the learned Additional Senior Civil Judge, Ongole.

It is brought to our notice that during pendency of the appeal, the respondent - husband died and this Court, on 05.11.2014, granted two weeks' time to bring the legal representatives of the deceased-husband on record. Subsequently, when the matter was listed on 19.11.2014, further time was granted. Despite granting sufficient time, no steps have been taken to bring the legal representatives of the deceased-husband on record. Therefore, the appeal deserves to be dismissed as abated.

Accordingly, the Civil Miscellaneous Appeal is dismissed as abated. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
