THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1903 of 2015 ORDER:

1. This Criminal Revision Case is filed by the petitioner challenging the order dated 31.7.2015 passed in Crl.M.P.No.171 of 2015 in M.C.No.73 of 2014 by the Additional Metropolitan Sessions Judge for the Trial of Jubilee Hills Car Bomb Blast Casecum-Additional Family Court, Hyderabad.

2. The petitioner is the husband of the 2nd respondent and the father of the 3rd respondent. The 2nd respondent filed the above M.C. seeking maintenance from the petitioner-husband. During the pendency of the above M.C., the 2nd respondent filed the above Crl.M.P. on her behalf and on behalf of her daughter, for interim maintenance of Rs.10,000/-p.m. and Rs.5,000/- p.m., respectively. The Court below directed the petitioner to pay an amount of Rs.2,500/- p.m., to each of respondents 2 and 3 towards interim maintenance. Aggrieved by the same, the petitioner filed this revision.

3. Heard and perused the material available on record.

4. Considering the facts and circumstances of the case and the relationship between the parties and in view of the pendency of the maintenance case, without expressing any opinion on the merits of the case, the revision case is disposed of with the following direction:

(i) The petitioner is directed to pay interim maintenance at the rate of Rs.1,250/- p.m., to each of respondents 2 and 3 on or before 10th of every succeeding month, till disposal of the above M.C; (ii) The petitioner is further directed to pay the arrears of maintenance from the date of petition viz., Crl.M.P.No.171 of 2015, at the rate fixed by this Court within three months from the date of receipt of a copy of this order.

(iii) The trial Court is directed to dispose of the above M.C. as early as possible.

(iv) The above order does not stand in the way of the trial Court in passing appropriate final orders in the above MC. The miscellaneous petitions pending, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO Dated: 8th September, 2015 Nn
