HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.23749 OF 2019 ORDER (ORAL) :

This Writ Petition is filed by the petitioners seeking to declare the action of respondent No.2 - Station House Officer, Kothagudem III Town Police Station, Kothagudem, Bhadradri Kothagudem District, in calling them to police station without any reason as being illegal and arbitrary, and for a consequential direction to unofficial respondent No.3 not to call them to the police station.

2. Heard Sri M.V. Venu, learned counsel for the petitioners, and learned Assistant Government Pleader for Home appearing for respondent Nos.1 and 2, and perused the material on record.

3. Learned Assistant Government Pleader for Home based on the written instructions dated 13.11.2019, a copy of which is placed before this Court, would submit that on the complaint of respondent No.3 herein, a case in Crime No.65 of 2018 has been registered against the petitioners herein for the offences punishable under Sections 498-A and 324 of Indian Penal Code, 1860, and Sections 3 and 4 of Dowry Prohibition Act, 1961, on 11.04.2018, and during the course of investigation in the said crime, witnesses were examined and their statements were recorded and obtained medical certificate of injured LW.1. Further, in the course of investigation, the provision under which petitioner No.1 was charged has been altered from Section 324 to Section 326 of IPC. With regard to the allegation that

the petitioners were taken to police station on 21.10.2019 and 24.10.2019 and made them to sit in the police station till late evening, he submits that except investigating into above crime in accordance with law, police never called the petitioners to police station nor made them to sit in the police station.

4. In view of the aforesaid submissions made by the learned Assistant Government Pleader on behalf of respondent No.2, this Court of is of the view that no further orders are required to be passed in the matter.

5. Therefore, recording the submission of the learned Assistant Government Pleader for Home, the writ petition is closed. No order as to costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the writ petition stand closed.
