THE HON'BLE SRI JUSTICE M.S.K.JAISWAL Criminal Petition No.11727 of 2016 ORDER:

The petitioner filed this Criminal Petition under Sections 482 read with Section 457 Cr.P.C. praying to pass orders directing the S.H.O., Eturunagaram Prohibition & Excise Station, Warangal District to release the Hero Glamour Motor Cycle bearing Temporary Reg.No.TS 03 ETR 1737 (Engine No.JA 06EJF9D15665 and Chassis No.MBLJA06AMF9D15676) worth of Rs.15,000/- seized in C.O.R.No.50 of 2016 by permitting the petitioner to furnish third party surety before the Court of Judicial First Class Magistrate at Mulug, Warangal District.

Heard and perused the records.

Having regard to the facts and circumstances of the case, the Criminal Petition is disposed of directing the petitioner to file application before the Deputy Commissioner of Prohibition & Excise, Warangal - 2nd Respondent herein seeking release of vehicle and on filing of such application, the 2nd Respondent herein shall dispose of the application within a period of one week from the date of filing of the application. Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, in the Criminal Petition shall stand closed.
