HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE M.S.K.JAISWAL C.M.A.No.356 of 2008 ORDER : (Oral) (Per Hon'ble Sri Justice Suresh Kumar Kait) On 13.12.2017, this Court passed the following order : "The record reveals that on the last five occasions consecutively this Court adjourned the matter at the request made by the learned counsel for the appellant to get instructions. Even today, same request is made by her. Last opportunity is granted to the learned counsel for the appellant to get instructions in the matter. It is made clear that if the counsel for the appellant will not advance her arguments on the next date of hearing, this appeal will be dismissed for non-prosecution. List the matter after two weeks."

Today also, counsel for the appellant seeks adjournment to take instructions.

The conduct of the counsel for appellant seems to be not arguing the present appeal.

Therefore, the appeal is dismissed for non-prosecution. No order as to costs.
