THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1842 OF 2016 ORDER:

This Criminal Petition is filed by the petitioners-accused Nos.1 and 3 under Section 482 Cr.P.C. seeking to relax the conditions imposed by the VII Additional District & Sessions Judge, Vijayawada, vide order, dated 03.11.2015, in Crl.M.P. No.1748 of 2015. Heard and perused the material available on record. While grating bail to the petitioners, the learned Sessions Judge, imposed a condition that the petitioners shall appear before the SHO concerned, on every Thursday and Sunday between 4 to 6 p.m. Learned counsel for the petitioners submitted that the petitioners are regularly attending before the SHO concerned, as directed by the Court below and since they are working as coolies on daily wage basis, it would become very difficult for them to attend before the SHO concerned, twice in a week and hence, he requested to relax the above condition.

Considering the submissions of the learned counsel for the petitioners, this Court is inclined to relax the conditions imposed on the petitioners.

Accordingly, the Criminal Petition is allowed and the condition imposed on the petitioners to appear before the SHO concerned, on every Thursday and Sunday between 4 to 6 p.m., by the VII Additional Sessions Judge, Vijayawada, vide order, dated 03.11.2015, in Crl.M.P. No.1748 of 2015 is relaxed.
