Heard learned counsel for petitioner and learned Government Pleader for Cooperation.

When this writ petition was filed, petitioner was aged 53 years and was working as Chief Executive Officer of Primary Agricultural Cooperative Society G.Gowraram. Petitioner challenged the orders dated 13.10.2008 of the Registrar of Cooperative Societies granting sanction for prosecution under Section 83 (3) of the A.P. Cooperative Societies Act, 1964. This Court by order dated 31.10.2008 granted interim suspension and on due consideration of the submissions of learned counsel for respondents, this Court by order dated 15.7.2015 made the interim order as absolute.

When the matter is taken up for consideration, learned counsel for petitioner informs the Court that on attaining the age of superannuation, petitioner retired from service. It is also brought to the notice of the Court that simultaneously surcharge proceedings were initiated and C.T.A.No. 8 of 2008 is pending before the Cooperative Tribunal.

Having regard to the submissions of learned counsel for petitioner that petitioner stood retired from service during the pendency of the writ petition, question of proceeding further pursuant to sanction granted on 13.10.2008 may not arise. Accordingly, writ petition is disposed of. No costs.

Miscellaneous petitions, if any pending, are closed.
