THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39408 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to call for records in FIR No.42 of 2016 and to quash the same. The case of the petitioners is that the 2nd petitioner being the brother-in-law of the 1st petitioner trespassed into the house of the 4th respondent along with some unknown persons on 20.02.2016 and slapped him and also kicked and also abused the 4th respondent and his wife in filthy language and intimidated him that if 4th respondent does not withdraw the cheque bounce case filed against the 1st petitioner, he would see his end. The main grievance of the petitioners is that the 4th respondent lodged the present complaint against the petitioners before the 3rd respondent on 10.03.2016 and the 3rd respondent registered the same as Crime No.
42 of 2016 against the petitioners for the offences under Sections 448, 323, 506 & 509 read with 34 IPC. Since the respondents are not allowing the petitioners to carry on their business, the petitioners have filed the present writ petition. Considering the grievance of the petitioners, the 3rd respondent is directed to complete the investigation in FIR No.42 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed.
