THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL MISCELLANEOUS APPEAL No.1105 OF 2009 ORDER:

This civil miscellaneous appeal is filed under Order XLIII Rules 1 and 2 of CPC, assailing the order dated 16.4.2008 passed in I.A. No.338 of 2006 in O.S.No.53 of 2006 on the file of the Court of Senior Civil Judge, Machilipatnam.

As per the Office note, the trial Court disposed of the suit on 29.4.2015. In view of the disposal of the suit, no purpose will be served by keeping the appeal pending.

Hence, the civil miscellaneous appeal is dismissed as infructuous. Miscellaneous petitions if any pending in this appeal shall stand closed.
