HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.28651 of 2016 ORDER:
Vide the present petition, the petitioner seeks Mandamus declaring the action of respondent No.3 in discontinuing the services of the petitioner for providing security services vide proceedings Rc.No.A11/ HDS/ GHS/ 2016/2702, dated 09.08.2016, as illegal and arbitrary. Learned Government Pleader appearing on behalf of respondents No.1 to 3 submits that an amount of Rs.41,15,195/- has already been paid to the petitioner on 27.8.2016 and the balance amount of Rs.23,87,292/- will be paid on furnishing Attendance certificates, salary paid to the workers, ESI and PF of the petitioner.
Learned counsel appearing on behalf of the petitioner submits that the petitioner has furnished all the required documents to the respondents and it is in the knowledge of respondent No.3.
Be that as it may, the balance amount of Rs.23,87,292/- has to be paid to the petitioner by the respondents.
Accordingly, I hereby direct the respondent No.3 to pay the amount due to the petitioner within four (04) weeks
from today. Failing which, respondent No.3 shall pay interest at the rate of 9% p.a. on delayed payment. With the above direction, this Writ Petition is disposed of. No costs. Pending miscellaneous petitions, if any, shall stand dismissed.
