HON'BLE SRI JUSTICE P.NAVEEN RAO ORDER:

The relief sought in the writ petition is, against refusing permission to fit the motor pump to the petitioner's bore-well drilled in his land in Sy.No.487-3 of Musturu Village, Bathalapalli Mandal, Anantapur District as illegal and violative of the A.P.Water, Land and Trees Act, 2002.

2. On 03.02.2015, as the State of Andhra Pradesh was not made a party to the writ petition and only Officers of the State were impleaded as respondents, the matter was directed to be listed under the caption of 'dismissal'.

3. When the matter was called on 03.03.2015, there was no representation on behalf of the petitioner. However, to give one more opportunity, the matter was adjourned and is being listed from time to time. Today also, when the matter is called, there is no representation on behalf of the petitioner.

4. Learned Government Pleader produced instructions furnished by the Tahsildar, Bathalapalli, dated 02.02.2015. According to the instructions furnished by the Tahsildar, the Mandal Revenue Inspector inspected the subject site and found that illegal bore-well was closed and does not exist on the petitioner's field and there is no standing crop existing on the field and bore well is not in use at present.

5. In view of the report of the Tahsildar, Bathalapalli, the cause in the writ petition does not survive and accordingly, it is dismissed.

There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
