THE HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.9058 of 2013 ORDER:

In this Petition filed under Section 482 Cr.P.C., the petitioners/accused Nos.1 and 3 seek to quash the proceedings in PRC.No.17 of 2013 on the file of Addl. Judicial First Class Magistrate, Madhira, whereunder the petitioners along with Twelve others were charged for the offences under Sections 147, 148, 302, 120(b) r/w 149 IPC.

When the matter came up for hearing, learned Public Prosecutor by producing a copy of the Judgment in Sessions Case No.439 of 2014 on the file of Judge, Family Court-cum-Addl. Sessions Judge, Khammam, submitted that PRC was committed to Sessions Court and thereafter it was numbered as S.C.No.439 of 2014 and after full pledged trial, the case was ended in acquittal, as per the Judgment dt.19.06.2015, and in view of the same, the present Petition, which is filed for quashment of the proceedings, has became infructuous and prayed to dismiss the petition.

There is no representation for the petitioners. On perusal of the copy of the Judgment in S.C.No.439 of 2014 on the file of Judge, Family Court-cum-Addl. Sessions Judge, Khammam, produced by the learned Public Prosecutor, the instant petition, which is filed to quash the proceeding in PRC No.17 of 2013 on the file of Addl. Judicial First Class Magistrate, Madhira, is held infructuous and accordingly dismissed.

Accordingly, this Criminal Petition is dismissed as infructuous.

Consequently, the miscellaneous petitions, if any, pending, in this case, shall stand closed.
