HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.41249 OF 2014 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of the respondents in proposing to auction the lease hold rights of the lands to an extent of Ac.22.38 guntas of dry land situated at Sy.No.637 and Ac.21.19 guntas of dry land situated in Sy.No.466 of Koheda Village, Hayathnagar Mandal, R.R.District, belonging to the 4th respondent temple in furtherance of the proceedings Rc.No.C/3592/2003, dated 09.12.2014 of the Assistant Commissioner, Endowments Department, Ranga Reddy District on 12.01.2015, as illegal and arbitrary and for a consequential direction to the respondents not to interfere with the peaceful physical possession and enjoyment of the petitioners in respect of the above said lands.

Heard learned Counsel for the petitioner.

Learned Standing Counsel for the 4th respondent produced proceedings vide Rc.No.C/39/2015, dated 06.02.2015 wherein the claim of the 1st petitioner seeking declaration of his status as land less poor person has been rejected by the 3rd respondent. Learned counsel for the petitioners states that the 1st petitioner is taking steps to file appeal before the Regional Joint Commissioner against the proceedings dated 06.02.2015, issued by the 3rd respondent.

In view of the above, it is open for the petitioners to file appeal against the proceedings dated 06.02.2015 before the

Regional Joint Commissioner and on such appeal being filed the Regional Joint Commissioner shall consider the same in accordance with law.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petition if any, pending in the writ petition shall stand closed.
