HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.24286 OF 2008 ORDER:

The petitioners pray for the following relief: "..Writ of Mandamus declaring the action of the respondents in not disbursing an amount of 95 lakh rupees, derived out of the sale of fish in the tanks leased out to the 1st respondent, to all its valid members like the petitioners and in attempting to misappropriate the same in the names of bogus and fictitious memberships as illegal, arbitrary, unjust, malafide and against the principles of natural justice, and consequently direct the respondents to disburse the amounts derived out of the sale of fish in Mohinuddin Saheb tank in Brundavanam village hamlet of Pulipadu, East Veerayapalem tank in East Veerayapalem village and Pothakamuru tank in Pothamamuru village to all legally valid members of the 1st respondent society only.." At the time of hearing, Mr.

Jyothi Prasad submits that the 2nd respondent alone, if so advised, may be interested in working out the legal remedies against the grievances vis-à-vis deposit of Rs.95,00,000/- for and on behalf of 1st respondent society and requests the Court to permit him to withdraw the writ petition with liberty to avail the remedies as indicated above.

The request is accepted and the writ petition is dismissed as withdrawn by granting liberty as prayed for. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. __________ S.V.BHATT, J Date:01.06.2016 Stp
