Respondents WHEREAS the Petitioner above named through its Advocate Smt. VEDULA CHITRALEKHA presented this Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ or order or direction, more particularly one in nature of Writ of Mandamus, to declare the action of the respondents in denying voting right to the workmen who completed continuous service of 6 months by the date of the election i.e., 05.01 .2024, on the ground that the said period has to be reckoned with reference to the date of notification being 04.12.
2023, as unreasonable, arbitrary and contrary to the Rules framed under the lndustrial Disputes Act, 1947 and to issue a consequential direction to the respondents to permit those workmen who have completed 6 months continuous service by the date of election; AND WHEREAS the High Court upon perusing the petition and affidavit filed herein and upon hearing the arguments of Smt. VEDULA CHITRALEKHA, Advocate for the Petitioner, directed issue of notice to the Respondents herein to show cause as to why this WRIT PETITION should not be admitted.

are directed to show cause on or before 26-12-2023 to which date the case stands posted as to why in the circumstances set out in the petition and the affidavit filed therewith (copy enclosed) this WRIT PETITION should not be admitted. lA NO: 1OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents not to proceed in any manner for conducting the elections to the Works Committee in the 1st respondent establishment in furtherance to Notification, dt.04.12.2023 pending disposal of WP No. 34261 of 2023, on the file of the High Court.
