THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8250 of 2016 ORDER:
The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of WRIT OF MANDAMUS, declaring the inaction of the respondents 4 and 5, in registering the crime against the cognizable offences, punishable U/Sec.
120-B, 354 (under Nirbhaya Act, 2005), 509, 324, 506 R/W 34 IPC and other sections under Indian Penal Code, against the unofficial respondents 6 to 12 for their brutal and merciless attack upon the petitioner and her daughter, as opposed to the canons of natural justice, apart from depriving right to life, guaranteed as fundamental rights under Constitution of India under Articles 14 and 21 and consequently direct the respondents 4 and 5 to register the case as per the guidelines framed by the Hon'ble Apex Court in Lalitha Kumari Vs Government of Uttarpradesh, (2014) 2 SCC 1 and to pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case." The Sub-Inspector of Police, Patamata Police Station, Vijayawada City, furnished written instructions dated 21.03.
2016 to the office of the learned Government Pleader for Home, wherein he stated that upon the complaint made by the petitioner, Crime No.163 of 2016 was registered under Sections 323 and 290 I.P.C. read with Section 34 I.P.C. on the file of the said police station and investigation was taken up.
In the light of this development, the grievance of the petitioner stands settled.
The writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
