THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE DR JUSTICE SHAMEEM AKTHER WRIT APPEAL NO.1506 OF 2005 JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} None appears for the respondents.

The contention of the appellant (who is the third respondent in Writ Petition No.5799 of 2005) is that the Writ Petition was allowed at the stage of admission without putting the appellant herein on notice and without giving them an opportunity of being heard. On this short ground, the order under appeal necessitates being set aside and is, accordingly, set aside. WP.No.5799 of 2005 is restored to file. The appellants herein shall file their counter affidavit within two weeks from today. The Writ Petition shall be taken up for hearing any time after two weeks. The Writ Appeal is disposed of, accordingly. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
