THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 23818 of 2019 ORDER:
This Writ Petition is filed for the following relief: "....to issue Writ Order or direction more particularly one in the nature of Writ of Mandamus by declaring the action of the Respondents in not disposing the petitioner application No.3/C1/13655/2019 dated 31.07.2019 for 1799/Western part of Weavers' Colony, Bhavana Nagar within the limits of GHMC Kapra Circle Keesara Mandal Medchal-Malkajgiri (old Ranga Reddy) District, is illegal, arbitrary and violative of the principles of natural justice and consequently direct the Respondents to grant building permission without referring to the shortfall letter dated 27.09.2019 and this Honourable Court may be pleased to grant building permission."
When the matter is taken up, it is submitted by the learned counsel for the petitioner that the issue raised in the present Writ Petition is squarely covered by the order dated 19.04.2016 passed by this Court in Writ Petition No. 37810 of 2015. Learned Standing Counsel for Greater Hyderabad Municipal Corporation appearing for the respondents does not dispute the aforesaid submission.
Relevant portion of the aforesaid order reads as under: "The writ petition is accordingly allowed setting aside the impugned proceedings dated 13.03.2014. The Greater Hyderabad Municipal
CKR, J W.P.No.23818 of 2019 Corporation shall reconsider the building permission application of the petitioner on its own merits and in accordance with the Greater Hyderabad Municipal Corporation Act, 1955, and the rules and regulations framed thereunder."
In those circumstances, following the above said order and for the reasons recorded therein, this Writ Petition is also allowed in terms thereof.
