HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 21591 of 2007 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the award passed on 01.07.2003 by the Labour Court, Guntur in I.D.No.43 of 1996 is arbitrary, illegal and unsustainable and thereby set aside the same. 2) By an order dated 24.06.2011, this Court directed the learned counsel for the petitioner to take out personal notice to respondent No.2 by registered post with acknowledgment due and file proof of service within a period of two weeks, in default the writ petition shall stand dismissed as against respondent No.2 without further reference to the Court. Since the said order is not complied with, the writ petition was dismissed against respondent No.2, who was successful before the lower Court. In view of the above, this Court is of the view that nothing survives for adjudication, as the writ which was filed against the order passed by the first respondent in favour of the second respondent was dismissed against the second respondent. 3) Accordingly, the writ petition is dismissed as infructuous. There shall be no order as to costs.

4) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
