HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.22104 of 2015 ORDER:

The petitioners are joint mutawallis - Sajjad Nasheen of Dargah Hazrath Syed Baji Shaheed Aulia, Peddakakani Village and Mandal, Guntur District. On account of allegations against the petitioners, they were suspended on 11.04.2014 and the wakf institution was taken under the direct management of the Wakf Board. Later, on 01.05.2014, an enquiry officer was appointed. When no further action was taken, the present Writ Petition is filed.

Learned counsel for the petitioners submits that Rule 24-A of the Wakf Rules, 2000, provides that an enquiry should be completed within six months and, even after more than one year, no report was submitted by the enquiry officer. Though the learned Standing Counsel for the Wakf Board took notice on 16.07.2015, no instructions are obtained by him. In the circumstances, this Court is inclined to dispose of the Writ Petition directing the fourth respondent to conclude the enquiry, within a period of thirty days from the date of receipt of a copy of this order, and submit a report to the third respondent for further action.

The Writ Petition is, accordingly, disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs. _______________________________ A. RAMALINGESWARA RAO,J
