THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6724 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioners who are arrayed as Accused Nos.1, 2 and 5 in the event of their arrest in Crime No.334 of 2022 on the file of Station House Officer, Ghatkeshwar Police Station, Rachakonda registered for the offences punishable under Sections 406, 420, 467, 468 and 471 read with Section 34 of Indian Penal Code.

Heard learned counsel for the petitioners/Accused Nos.1, 2 and 5 and learned Assistant Public Prosecutor for the respondentState. Perused the record. 3.

As seen from the complaint, the petitioners were involved in registration of sale deed in favour of Accused Nos.1 and 2 by Accused Nos.4 and 5 by creating fake documents and IDs. 4.

Learned counsel for the petitioner submits that the case is purely civil in nature and for the reason of civil disputes, a false complaint is filed.

In view of the transactions being executed before the concerned office, since the documents are public documents, the same are available with the concerned office, the petitioners can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.1, 2 and 5 shall be enlarged on bail in the event of their arrest subject to the following conditions: i) The petitioners/Accused Nos.1, 2 and 5 are directed to surrender before the Station House Officer, Ghatkeshwar Police Station, Rachakonda within one week from today, and on such surrender, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each with two sureties to the like sum each, to its satisfaction. ii) The petitioners/Accused Nos.1, 2 and 5 shall assist investigation and provide the details necessary for concluding the investigation. Accordingly, these petitioners/Accused Nos.1, 2 and 5 are directed to appear before the concerned Station House Officer on every day from 08.08.2022 to 05.09.2022 between 10.30 AM and 01.00 PM and thereafter as and when required.

iii) The petitioners/Accused Nos.1, 2 and 5 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 04.08.2022 ns
