HONOURABLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No. 8836 OF 2008 ORDER:

This Writ Petition is filed for the following relief: " For the reasons stated in the accompanying affidavit, it is hereby

prayed that this Honourable Court may be pleased to issue a Writ, order or direction more particularly one in the nature of Writ of mandamus declaring the action of the respondents in not refunding or adjusting the excess amount collected towards Property Tax which comes to Rs.1,78,854/- in respect of the House bearing No.1-5-91 (old) corresponding to New House No.1-5-282 situated at Rama Reddy Road, Kamareddy Town, Nizamabad District as illegal, arbitrary and against the constitutional norms apart from being in violation of the provisions of A.P. Municipalities Act, 1965 and Rules made there under and consequently direct the respondents herein to forthwith refund or adjust the excess amount collected as property tax.." When the matter is taken up for hearing, the learned Standing Counsel for the second respondent-Municipality submits that the amount claimed in the Writ Petition has already been adjusted and hence no further orders need be passed in the Writ Petition.

Recording the said submission of the learned Standing Counsel for the second respondent-Municipality, the Writ Petition is closed. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
