THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Crl.P.M.P.No.17836 of 2014 in Crl.P.No.16547 of 2014 and Crl.P.No.16547 of 2014 Common Order:
The de-facto complainant and his counsel Sri N.Ashok Kumar are present. Accused Nos. 2 and 3 and their counsel Sri P.Prabhakar Reddy are present. Heard both sides.
The Police of Central Crime Station, Hyderabad registered FIR No.236 of 2014 against A1 to A3 for the offences under Sections 419, 420, 468, 471 120B IPC and the investigation is stated to be pending. Now, the submission of both sides is that at the intervention of elders both the parties have amicably settled the property disputes and in fact they have entered into compromise in civil suit-O.S.No.421 of 2014 on the file of XI Additional Chief Judge, City Civil Court, Hyderabad and in the present criminal proceedings also they have entered into a compromise and therefore, permission may be accorded to them for entering into compromise and compromise may be recorded and criminal proceedings may be quashed.
Having regard to the above said submission and considering the fact that it is a property dispute and parties have amicably settled their disputes and no useful purpose will be served if they are driven to trial and
following the decision reported in Gian Singh vs. State of Punjab and another (2012) 10 SCC 303) compromise is recorded in terms of accompanying compromise petition and consequently the proceedings in FIR No.236 of 2014 of Central Crime Station, Hyderabad in sofaras petitioners/A2 and A3 are concerned are hereby quashed..
In the result, both the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
