HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.28363 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction on the part of the second and third respondents as illegal and arbitrary.

2. Heard the learned counsel for the petitioner, the learned Government Pleader for Panchayat Raj and Rural Development representing the respondents 1 to 3 and the learned Standing counsel for Panchayat Raj, representing the fourth respondent (Andhra Pradesh).

3. A perusal of the record reveals that the fourth respondent has been working as Panchayat Secretary of Karlapalem village and Mandal of Guntur District. It appears that some of the villagers made complaint against the fourth respondent. On 05.03.2016 the government issued a memo No.2899/M/d1.I/A2/2016 dated 05.03.2016 directing the Commissioner as well as the second respondent to examine the allegations leveled against the fourth respondent. The petitioner herein submitted a representation to second and third respondents on 25.07.2016 requesting them to take appropriate action against the fourth respondent. The grievance of the petitioner is that the respondents 2 and 3 have not taken any action against the fourth respondent.

4. At the time of arguments, the only relief sought by the petitioner is to direct the respondents 2 and 3 to dispose of his representation dated 25.07.2016. Learned Assistant Government

Pleader for Panchayat Raj and the learned Standing Counsel for Panchayat Raj also consented for the same.

5. In view of the submissions made by both the counsel, this Court is not inclined to go into the merits of the main case.

6. Having regard to the facts and circumstances of the case and also the submissions made by both the counsel, the second and third respondents are hereby directed to dispose of the representation of the petitioner dated 25.07.2016 in accordance with law, as expeditiously as possible, preferably, within a period of two months from the date of receipt of copy of this order.

7. Accordingly, this writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
