THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.2217 OF 2011 ORDER:

The writ petition is filed seeking a writ of mandamus declaring the action of the respondent No.3 in not according permission for construction on the petitioners' application dated 01.08.2009 for the premises bearing H.No.8-3-168, admeasuring 287.68 square yards, situated at Erragadda, Hyderabad, for construction of cellar plus three upper floors as illegal, arbitrary and contrary to GHMC Act and Rules and consequently, declare that it is deemed permission under Section 437 of the HMC Act and also direct the respondents not to interfere into the construction in H.No.8-3-168, admeasuring 287.68 square yards, situated at Erragadda, Hyderabad.

Heard and perused the material.

This Court, by an interim order, dated 18.02.2011, granted interim direction directing the petitioner to proceed with the construction according to the plan submitted and if there is any violation of the Rules of the Municipal Corporation or building bye-laws, the respondents are at liberty to take steps in accordance with law.

The writ petition is disposed of observing that the interim order, dated 18.02.2011, is made absolute as the writ petition pertains to 2011. The writ petition is accordingly disposed of.
