HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 18152 OF 2004 ORDER :
When the matter is taken up for hearing, it is noticed that the Writ Petition against the 2nd respondent was dismissed for default on 29.12.2010 and thereafter the petitioner has not taken any steps to ensure that the Writ Petition against the 2nd respondent is restored. The petitioner is challenging the orders passed by the Industrial Tribunal in ID No.5 of 1998, dated 28.11.2001, in so far as denying continuity of service and back wages and imposition of punishment of deferment of five increments with cumulative effect. The petitioner is seeking the relief against the 2nd respondent and, in the absence of 2nd respondent, the relief sought by the petitioner cannot be granted.

Accordingly, Writ Petition is dismissed.
