HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.10456 OF 2010 ORDER:

This Criminal Petition is filed by the petitioners/A.1 to A.3 respondents in DVC No.167 of 2010 on the file of the I Metropolitan Magistrate, Hyderabad, under Section 482 Cr.P.C seeking to quash the proceedings in the above D.V.C. Heard the learned counsel for petitioners and the learned Public Prosecutor for the State and perused the material on record.

Undisputedly, the DVC is pending since 2010 apart from the alternative efficacious remedy of appeal impugning the proceedings including taking cognizance. Instead of interfering with the order of cognizance by the learned Magistrate at this stage, to sub-serve the ends of justice, the learned Magistrate is directed to dispose of the DVC within two months from the date of receipt of the order.

Accordingly and in the result, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any shall stand closed.
