HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner was General Surgeon in Osmania Medical College, Hyderabad. By the order impugned in this writ petition, petitioner was transferred from Osmania Medical College, Hyderabad to Government Medical College, Nizamabad, Nizamabad district. This order is under challenge on various grounds.

However, during the course of hearing, learned counsel for petitioner submits that there are certain grave irregularities in transfer counseling exercise undertaken and he intends to highlight those irregularities before the Government. He also submits that there are two vacancies existing in the city of Hyderabad and due to certain personal difficulties of petitioner, he needs to be located in Hyderabad at least for some time. Learned counsel therefore seeks leave of the Court to make a representation to the Government to highlight illegalities in transfer exercise undertaken by the Department and to request his retention in Hyderabad in one of two available existing vacancies. 3.

Having regard to this submission, without entering into the merits of respective contentions, Writ Petition is disposed of granting liberty to petitioner to make a representation to the Principal Secretary to Government, Health, Medical & Family Welfare Department, Telangana State, ventilating his grievance against transfer exercise of Medical Officers undertaken by the Department and his personal difficulties for retention in Hyderabad and if such representation is made, the Principal

Secretary to Government shall objectively consider the objections of petitioner and also to consider request of petitioner if there are vacancies available and his request can be considered and pass appropriate orders, within a period of three weeks from the date of receipt of such representation. Pending miscellaneous petitions shall stand closed.
