HON'BLE SRI JUSTICE S.V.BHATT W.P.No.40190 OF 2012 ORDER:

The petitioner prays for Mandamus declaring the inaction of respondents in allotting land of an extent of Ac.0-20 cents in Sy.No.282/1, Kotturu Village and Mandal, Srikakulam District, on market value as recommended through Rc.No.24/96A dated 31.03.1997 and D.Dis.No.3752/96 H dated 01.10.1997, as illegal and unconstitutional.

Heard Mr.G.Tuhin Kumar for petitioner and Assistant Government Pleader for Assignment.

The prayer is one against inaction in disposing of the representation of petitioner for alienating the petition land. The Assistant Government Pleader admits that the representation has not been attended to and any final order either accepting or refusing is given to petitioner by respondents. He further submits that this Court can consider giving liberty to petitioner to re-submit the appeal Ex.P12 filed along with the writ papers to respondent Nos.2 and 3 and appropriate decision will be taken. His statement is placed on record. The writ petition is, accordingly, disposed of giving liberty to petitioner to re-submit the appeal Ex.P12 by enclosing a copy of this order to respondents 2 and 3 for consideration and disposal. The said exercise shall be undertaken within three months from the date of receipt of a copy of representation.

It is made clear that this Court has not examined merits of the matter and it is for the authorities to examine the availability of land for alienation/assignment, entitlement of petitioner and appropriate decision be taken.

The writ petition is disposed of as stated above. There shall be

no order as to costs.

Consequently, miscellaneous petitions, if any pending, also stand closed.
