HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.4103 OF 2015 ORDER:

In this Writ Petition, the petitioner has questioned the action of the respondents in seeking to recover Value Added Tax (VAT) @ 5% on the bills payable to them.

At the time of hearing, Sri P. Venkata Rao, learned counsel for the petitioner, and the learned Government Pleader for Finance & Planning (AP) for respondents 1, 3 and 6, learned Government Pleader for Irrigation (AP) for respondents 2, 4 and 5, learned Government Pleader for Commercial Tax Department (AP) for respondents 7 and 8 and learned Government Pleader for Commercial Tax Department (Telangana) for respondent No.9 submitted that the issue identical to that raised in this Writ Petition has been adjudicated by this Court by an order dated 06.11.2012, in W.P.No.34569 of 2012. In view of the above submission, this Writ Petition is disposed of in terms of order dated 06.11.2012 in W.P.No.34569 of 2012 with the direction that the reasons and directions contained therein shall form part of this Order.
