This petition is filed to withdraw F.C.O.P.No.307 of 2016 from the file of II Additional Family Court, Kukatpally at Miyapur, Ranga Reddy District, and transfer the same to Principal Senior Civil Judge, Kothagudem, Khammam District.

Wife filed this petition. According to her affidavit, her marriage with respondent was solemnized on 18.03.2012 as per Hindu rites and custom at her parents' house at Kothagudem town. She stated that one month after marriage, respondent and her sister started harassing her both physically and mentally and that she was blessed with a female child on 19.09.2013 thereafter they started insulting and harassing her more, and finally she was necked out from the house and having no other go, she came back to her parents house and staying there. She stated that she lodged a complaint and the same is pending before II-Additional Judicial First Class Magistrate, Kothagudem, and that she filed D.V.C.No.22 of 2015, which is also pending before II-Additional Judicial First Class Magistrate, Kothagudem, and respondent intentionally filed F.C.O.P.No.
307 of 2016 before II-Additional Family Court, Kukatpally at Miyapur, for dissolution of marriage. She stated that distance between her place of residence and Miyapur is about 200 kms. and it is difficult for her to travel by spending huge money.

This Court permitted petitioner to take personal notice both to respondent and also to his advocate on record in the lower Court. Advocate for petitioner submitted that notice sent to respondent is returned with endorsement 'unclaimed' and notice sent to his advocate on record is duly served and field the postal acknowledgment along with memo dated 29.06.2016. In spite of service of notice on his advocate, respondent neither appeared in person nor through any advocate.

Heard advocate for petitioner.

Considering the reasons stated in the affidavit and also considering the convenience of wife, F.C.O.P.No.307 of 2016 is withdrawn from II Additional Family Court, Kukatpally at Miyapur, Ranga Reddy District, and transferred to Principal Senior Civil Judge, Kothagudem, Khammam District, for disposal in accordance with law.

Transfer C.M.P. is ordered accordingly.
