O R D E R

The grievance of the petitioner is that the respondent authorities have demolished part of the subject property without following the due process of law.

Learned Government Pleader for Irrigation, on instructions, submits that petitioner made constructions in the Full Tank Level (FTL) area, and hence the authorities have resorted to demolition. Learned counsel for the petitioner disputes that the constructions of the petitioner are in FTL area.

The fact remains that before taking action, the respondents have not issued any notice giving opportunity to the petitioner. In view of the same, without expressing any opinion on merits, writ petition is disposed of directing the respondents not demolish, dispossess or interfere with the possession of the petitioner over the subject property without following the due process of law.

Interlocutory applications pending, if any, shall stand closed. No order as to costs.
