THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Crl.P.M.P.No.1013 of 2015 in Crl.P.No.16600 of 2014 and Crl.P.No.16600 of 2014 Common Order:

T h e defacto complainants and their counsel Smt.K.S.G. Padmavathi are present. Accused No.2 and her counsel Sri P.Venkata Rao are present.

Heard both sides and perused the petition.

On the complaint given by defacto complainants, the Police of Chilakalapudi P.S, Krishna District registered a case in Crime No.133 of 2013 against the accused for the offences under Sec.406, 420 IPC and Sec.5 of Prize Chits and Money Circulation Scheme (Banning Act) 1978 and investigation is stated to be pending.

Now the submission of both parties is that at the intervention of elders, they have amicably settled the issue and they have received the subscription amounts from A.2 and hence they have no grievance against the A.2 and therefore, they have no objection for quashment of the proceedings against A.2 and hence, permission may be accorded to them to enter into compromise and record the compromise and quash the proceedings in the interest of justice.

Having regard to the above said submission and

considering the fact that it is a financial matter and the parties are known to each other and that they are willing to compromise the issue and live peacefully at the intervention of elders and also considering that no useful purpose will be served even if the investigation is allowed to be continued as the chances of the conviction of the accused in trial are bleak and also following the decision following the decision reported in Gian Singh vs. State of Punjab and another[1], this petition is allowed, permission is accorded and compromise is recorded and consequently the proceedings against A.2 in Crime No.133 of 2013 on the file of Chilakalapudi P.S, Krishna District are hereby quashed.

In the result, both the petitions are accordingly allowed.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
