HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.34167 OF 2016 ORDER:
This Writ Petition under Article 226 of the Constitution of India is preferred by the petitioner seeking to declare the inaction of respondents 2 to 4 in considering the representation dated 30.08.2016 made by the petitioner complaining against unauthorized digging of borewell by the 5th respondent as arbitrary, illegal and consequently to direct the 2nd respondent to act upon his representation.
Heard the learned counsel for the petitioner as well as the learned Government Pleader for Revenue (AP). With their consent, the Writ Petition is disposed of at the admission stage itself. Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the authorities to consider the representation of the petitioner dated 30.08.2016 at the earliest.
Having considered the rival submissions made and in view of the limited grievance of the petitioner, the writ petition is disposed of directing the 2nd respondent herein to consider the representation dated 30.08.2016 of the petitioner made by him complaining about the unauthorized digging of borewell by the 5th respondent and dispose of the same, if the same is still pending consideration, in accordance with law, after hearing the petitioner and also the aggrieved persons, if any, including the 5th respondent as early as possible preferably within a period of eight weeks from
the date of receipt of a copy of this order. There shall be no order as to costs.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
