THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No. 33283 of 2016 ORDER:

It is the case of the petitioner that his father worked as Village Revenue Assistant in the office of the fourth respondent and died on 29.11.2012 while in service leaving behind himself, his brother, two sisters and his mother. The petitioner submitted a representation on 09.01.2013 to consider his claim for appointment on compassionate grounds. But, his claim was rejected by proceedings dated 21.03.2016 of the fourth respondent. Against the said order the petitioner preferred an appeal/representation to the third respondent on 18.07.2016 stating that as per the Government rules he is qualified to hold the post of Village Revenue Assistant and without submitting the requisite information to the third respondent the fourth respondent passed an endorsement rejecting the request and his request should be considered as per the rules. The petitioner relied on the Government Orders issued in G.O.Ms.No.234, Revenue Department, dated 10.12.2015.

However, since the appeal/representation of the petitioner is pending before the third respondent, this Court is not inclined to entertain the present Writ Petition, but disposes of the Writ Petition with a direction to the third respondent to consider the appeal/representation of the petitioner dated 18.07.2016 submitted against the order of the fourth respondent dated 21.03.2016 in accordance with rules and pass appropriate orders thereon within a period of three (3) months from the date of receipt of a copy of this order and communicate the same to the petitioner. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
