THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.24654 of 2015 O R D E R:

This writ petition is filed with the following prayer: " ............... to declare the action of the Respondents 1 and 2 in publishing the Andhra Pradesh Gazettee No.46-A dt.15.11.2001 by notifying the list of agricultural properties of Andhra Pradesh State Wakf Board in Narsapur and Siddipet Taluks of Medak District including the lands of the petitioners in Sy.Nos 126, 127, 128, 129, 130, 131, 141, 143, 149, 159, 160 to 172, 173, 175, 178 to 183, 181, 180, 181, 183, 189 to 192, 211, 213, 215 to 218 and 225 to an extent of Ac.177.03 1⁄2 guntas of Shabhashpally Village, Shivampet Mandal, Medak District vide Sl.No.183.33 without conducting survey and without any notice to the petitioners or occupants as bad, arbitrary, illegal and contrary to the provisions of the Wakf Act and consequently set aside the said Gazette Notification 46-A dt.15-11-2001 in so far as the lands of the petitioners are concerned and pass such other and further order or orders deemed fit and proper in the interest of justice."

When the matter is taken-up, it is submitted by the learned counsel for the petitioners, so also the learned Standing Counsel for Telangana Wakf Board that the issue in the present case is squarely covered by order dated 22-09-2016 in WP.No.33133 of 2014 and copy of the same is placed on record.

Following the above said order and for the reasons recorded therein, this writ petition is also allowed in terms above mentioned order dated 22-09-2016. Consequently, the

miscellaneous applications pending, if any, shall also stand dismissed.
