THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.32930 of 2015 ORDER:

Petitioners question the action of the fourth respondent in seeking to evict them by issuing notices, dated 19.08.2015.

The impugned notices state that the Tahsildar has inspected the land assigned to the petitioners and found that there is no cultivation on it and hence, they have violated the Assignment Patta Allotment Conditions mentioned in Board Standing Order-15, and thereby, he sought explanation from the petitioners as to why such land could not be resumed so as to provide house-sites to the poor people. The petitioners state that they have filed detailed explanation on 22.08.2015 and the matter is pending before the fourth respondent. Therefore, they have filed this Writ Petition with the grievance that while no orders are passed by the fourth respondent in pursuance of the impugned notices and the explanations submitted by them, the fourth respondent and his subordinates are attempting to dispossess them from the land in question. I have heard learned counsel for the petitioners and learned Government Pleader for Revenue.

The petitioners have already been notified and they have submitted their detailed explanations to the impugned notices. It is therefore not necessary to entertain the Writ Petition but suffice it to say that the interests of justice would be served by directing the fourth respondent to consider the explanations submitted by the petitioners and only thereafter, pass appropriate order in accordance with law. Till passing of such order by the fourth respondent, he or his subordinates shall not interfere with the petitioners' possession over the land covered by the impugned

notices.

The Writ Petition is accordingly disposed of. Miscellaneous Petitions, if any pending in this Writ Petition shall stand closed. No order as to costs.
