THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.4074 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioners/A-1 to A-5 in P.R.C.No.3 of 2016 on the file of IX Additional Chief Metropolitan Magistrate, Nampally, Hyderabad arising out of Crime No.561 of 2014 of Abids, Hyderabad registered for the offences punishable under Sections 324 read with Section 34 IPC and Section 3 (1) (x) of Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989.

Heard and perused the material available on record. After arguing for sometime, the learned counsel for the petitioners, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioners before the trial Court.

In any event, considering the facts and circumstances of the case, the presence of the petitioners/A-1 to A-5 before the committal court as well as trial Court is dispensed with except on the dates when their presence is specially required for the purpose of commitment of the case to the Court of Session, framing of charges and also for examination under Section 313 Cr.P.C. However, the petitioners/A-1 to A05 shall be properly represented by their counsel.

Accordingly, the Criminal Petition is disposed of.

Consequently, miscellaneous petitions, if any, pending, shall stand closed.
