THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10106 of 2015 ORDER:
This Criminal Petition is filed by the petitioners - A1, A3 and A2, under Section 438 of the Code of Criminal Procedure, seeking to grant bail in Crime No.106 of 2015 on the file of Karapa Police Station, East Godavari District, registered for the offences punishable under Sections 498-A read with 34 IPC and 3 & 4 of the Dowry Prohibition Act.
Heard and perused the material available on record. The marriage between the 1st petitioner and the de facto complainant was performed in the year 2003. Out of wedlock, they blessed with a male child. Due to the harassment made by the petitioners for demand of additional dowry, the de facto complainant left the company of the 1st petitioner in the month of March, 2015 and filed the present complaint in the month of August, 2015. Since the present complaint arises out of a matrimonial dispute, this Court is of the view that arrest of the petitioners would cause prejudice in case of future settlement between the parties. Therefore, this Court is inclined to grant anticipatory bail to the petitioners.
In the circumstances, the petitioners - A1, A3 and A2 are directed to surrender before the Magistrate concerned on or before 21.10.2015 and on such surrender, they shall be released on bail on their executing personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) each with one surety for the like sum each to the satisfaction of the said Magistrate. Further, the 1st petitioner-A1 is directed to appear before the Station House Officer concerned, daily at 10 a.m. and at 5 p.m., till filing of charge sheet form the date of receipt of this order and the petitioners 2 and 3 - A3 and A2 are directed to appear before the Station House Officer concerned, as and when required.
Accordingly, the Criminal Petition is allowed. ______________
