HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.23989 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of learned counsel for the respective parties. This writ petition is filed seeking the following relief :- " ......to issue Writ, order or direction or writ more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not granting special grade increment in pursuance of the Circular No PD-04/ 2011 dated 12.1.2011 to the petitioners is illegal, arbitrary and unjust and consequently direct the respondents to grant special grade increments in pursuance of the Circular No.PD-04/ 2011 dated 12.1.2011 to the petitioners ....." .

Heard Mr.G.Rajesh, learned counsel for the petitioner and Sri N.Vasudeva Reddy, the learned Standing Counsel for the respondents.

It has been contended by the petitioner that he was appointed as a driver with the respondents during the year 1994 and he has put in more than twenty years of service and he is entitled for grant of special grade increment in terms of Circular dated 12.01.2011, but the respondents have not granted special grade increment. In those set of circumstances, the petitioner has filed a representation on 19.01.2019. But, so far, the respondents have not passed any orders on the said representation nor considered his case for grant of special grade increment. Learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the respondents to

consider the representation submitted by the petitioner on 19.01.2019 and pass appropriate orders in accordance with law. The learned Standing Counsel appearing for the respondents contends that the respondents would consider the case of the petitioner and pass appropriate orders on the representation submitted by the petitioner on 19.01.2019.

This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 19.01.2019 and pass appropriate orders in accordance with law within a period of six weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
