O R D E R
(Per Hon'ble Sri Justice Sanjay Kumar) The then Government of Andhra Pradesh and its officials in the Police Department filed this writ petition aggrieved by the order dated 13.05.2010 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad (hereinafter, 'the Tribunal'), in O.A.No.3033 of 2010. The O.A. was filed by the first respondent herein assailing the action of the authorities in not considering his case for promotion to the post of Deputy Superintendent of Police for the panel year 2009-2010 on par with his juniors. By order dated 13.05.2010, the Tribunal disposed of the O.A. directing the authorities to pass final orders pursuant to the Charge Memo dated 02.12.2006 issued to the petitioner and in the event no orders were passed within three months, they were directed to consider his case for promotion to the post of Deputy Superintendent of Police, if he was otherwise fit, eligible and came within the zone of consideration as per his seniority.
We are now informed by the learned Government Pleader for the State of Telangana, the successor-in-interest of the erstwhile Government of Andhra Pradesh in so far as this case is concerned, that the charges against the first respondent-applicant were dropped and he was considered for the promotion to the post of Deputy Superintendent of Police for the panel year 2010-2011 and was duly promoted under proceedings dated 20.02.2013 passed by the Director General of Police, Andhra Pradesh.
In that view of the matter, the learned Government Pleader would state that the cause in this writ petition does not survive for adjudication on merits.
The writ petition is accordingly dismissed. Interim order dated 13.12.2010 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs. _______________ SANJAY KUMAR, J _______________ M. GANGA RAO, J 23rd APRI L, 2018 Svv
