O R D E R

This writ petition is filed declaring the action of the respondents Nos.2 and 3 in not implementing the orders passed by the 1st respondent in Lr.No.7407/VIG/2008-3, dated 13.08.2009 in spite of the reminders dated 08.10.2009 and 06.11.2009, as illegal and arbitrary.

This Court on 07.06.2010 granted interim order which reads as follows:

".................In that view of the matter and as it is stted that respondents 2 and 3 have decided to reinstate the employees, who were involved in the alleged misappropriation, into service during the pendency of the disciplinary proceedings, and that except petitioners, all other persons were already reinstated into service, I directions respondents 2 and 3 to reinstate the petitioners into service. It is made clear that irrespective of an undertaking or agreement by the petitioners, the respondents are at liberty to proceed with the disciplinary proceedings against the petitioners and pass appropriate orders thereon, in accordance with the regulations."

Learned counsel for the petitioners submit that in pursuance to the interim order passed by this Court on 07.06.2010, the petitioners were reinstated into service.

In view of the above, this writ petition is disposed of interms of the interim order passed by this Court on 07.06.2010. No costs. As a sequel, miscellaneous petitions pending if any, shall stand closed.
