Heard the learned counsel for the petitioner, the learned Government Pleader for Panchayat Raj and Rural Development, and Sri Ravi Chimalapati, learned Standing Counsel for respondent no.4.
The petitioner was appointed as Field Assistant in Aanuru Village, Peddapuram Mandal, East Godavari District on 27.7.2007 by the 2nd respondent-District Collector, East Godavari District, at Kakinada.
Based on Social Audit conducted on 27.12.2014 leveling certain allegations of misappropriation against the petitioner, petitioner was issued with show cause notice for which the petitioner submitted his explanation. However, the petitioner was kept under suspension by the impugned order dated 24.1.2015. Challenging the same the present writ petition has been filed.
It is submitted by the learned counsel for the petitioner that one Mr. N. Veeraraju, who was working as a mate, is responsible for the alleged misappropriation and he paid the amount on 10.6.2015 and therefore keeping the petitioner under suspension is illegal.
Since the impugned order of suspension was passed pending enquiry, I am not inclined to examine the merits of the matter. In the circumstances, the writ petition is disposed of directing the 3rd respondent-Project Director, DWMA & Additional Program District Coordinator, East Godavari District, Kakinada to
conduct enquiry and pass appropriate final orders within a period of four weeks from the date of receipt of copy of this order, failing which the order of suspension shall stand revoked. Accordingly, the writ petition is disposed of at the admission stage. No order as to costs.
