This Criminal Petition is filed under Section 482 Cr.P.C. seeking relaxation of the condition imposed while granting bail vide order dt.26.09.2019 in Crl.M.P.No.4587 of 2019 in PRC.No.40 of 2018 in Crime No.472 of 2016 (P.S. Pahadishareef) passed by the learned Metropolitan Sessions Judge, Cyberabad, Ranga Reddy District, directing that the petitioner/A.7 shall be enlarged on bail "on completion of Committal proceedings" on her executing personal bond for a sum of Rs.10,000/- with two sureties for a likesum each to the satisfaction of the Committal Court subject to the condition that she shall attend the Court on the dates of hearing and shall not commit similar offence. Heard learned counsel for the petitioners/A.7 and the learned Additional Public Prosecutor appearing for the respondent - State. Perused the material on record.

Learned counsel for the petitioners contends that it is very difficult to comply with the above condition imposed by the Court below in the bail order, as A.3, A.4, A.6, A.9, A.10 and A.13 are absconding and NBWs are pending against them and until they get arrested, the proceedings cannot come for committal proceedings, due to which, even though the petitioner/A.7 obtained bail, the same became futile.

GSD, J Crl.P.No.6943 of 2019 learned counsel, therefore, sought for relaxation of the above said condition.

Having regard to the facts and circumstances of the case, the condition imposed by the court below while granting bail vide order dt.26.09.2019 in Crl.M.P.No.4587 of 2019 in PRC.No.40 of 2018 in Crime No.472 of 2016 (P.S. Pahadishareef) is hereby modified, while relaxing the condition of "on completion of Committal proceedings", directing that the petitioner/A.7 shall be enlarged on bail on her executing personal bond for a sum of Rs.10,000/- with two sureties for a likesum each to the satisfaction of the Committal Court subject to the condition that she shall attend the Court on the dates of hearing and shall not commit similar offence.

Accordingly, this Criminal Petition is allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
