HON'BLE SRI JUSTICE DILIP B. BHOSALE CIVIL REVISION PETITION No. 327 OF 2014 PC:

Heard learned counsel for the parties.

This C.R.P is directed against the order dated 07-10-2013 passed by the Court below on an application bearing I.A No. 1 of 2013 in I.A No. 325 of 2003 in O.S No.708 of 1997. By this application, the petitioner sought correction of boundaries in final decree. According to the petitioner, the Commissioner while partitioning the property as per the decree committed some error in mentioning the boundaries.

Learned counsel for the respondents, on instructions, submits that the respondents have no objection for carrying out the correction as prayed for in the application by the petitioner.

I have perused the order dated 07-10-2013 and so also the plan showing the existing house and its division made by the Commissioner. Having regard thereto and considering the consent given by the respondents for carrying out the correction of boundaries as prayed for in I.A No. 1 of 2013, I am satisfied that the following order shall meet the ends of justice:

"The order dated 07-10-2013, impugned in the present C.R.P, is set aside. I.A No. 1 of 2013 seeking correction of the boundaries is allowed." C.R.P is accordingly disposed of.
