THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8920 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime.No.997 of 2023 on the file of Vanasthalipuram Police Station, Rachakonda Commissionarate, registered for the offences under Sections 354 (D), 323 and 506 of IPC and Sections 11 and 12 of POCSO Act, 2012. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The petitioner was arrested on 21.08.2023. It is alleged in the complaint that this petitioner was a Driver of a Toofan vehicle. He was following the victim girl while she was going to school and also mis-behaved with her and asked to board his vehicle. Unable to bear his mis-behaviour, the complaint was filed. There are no

allegations of physical assault. All the offences are punishable upto 3 years.

The petitioner is in jail since 21.08.2023. Since, it appears that major part of the investigation is complete, the petitioner can be granted regular bail, subject to following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties, for a like sum each to the satisfaction of VII Additional Metropolitan Magistrate at Hayathnagar, Cyberabad.

ii) The petitioner/Accused after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of eight weeks or till the charge sheet is filed, whichever is earlier, for the purpose of investigation.

iii) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
